Capital Punishment Capital Punishment is regarded by most as a successful deterrent to murder, but that is because these people don’t look at it as it is applied. According to retributivists such as Kant and Van Den Haag the guilty deserves to be punished. On the other hand, people against the death penalty like Bedau think that the death penalty is just as much an effective deterrent as life in prison. The most famous retributivist Kant, states that the guilty ought to get punished because they chose to act wrongly, and by punishing them, we are respecting them as a moral agents. He is not concerned about sentencing innocent people to death because according to him there will always be innocent victims , but that number or percentage must be kept to a minimum. Over the past 85 years, there have been 25 who have proven to be innocent after death, but according to van den Haag this is a reasonable number because there will always be mistakes(van den Haag, pg252) . People against the death penalty say not only the guilty are being executed, and innocent lives are being taken, thus we should have a stricter death row sentence to see if it is possible the accuser will be innocent. Also, it would be too difficult to make a law that ensures that only those committing the worst crimes are sentenced to die, for example if an abused wife decided one day to get back at her husband and take his life. According to retributivists she doesn’t deserve to die even though she is guilty. Also, with the death penalty race, age and gender come into play. For example, there isn’t much media coverage on men on death row, but if there was a women on death row you wouldn’t miss a thing about it. Another example is the case of Ferman vs Georgia in 1972. For instance, among the most important laws may be named the Law of the People’s Republic of China on the Protection of Disabled Persons (Dec 28, 1990), according to which the main goal of the law is protection of disabled people and their rights, insurance of their equal and full participation in social life and their share of the material and cultural wealth in society (Stewart 2003). As for education of children with disabilities, the Chinese legislation pays particular attention to their problems. This legislation is particularly important when viewing children’s rights to an education. For instance, on August 23, 1994 the State Council of China promulgated Degree No 161 â€Å"Regulations on the Educations of Persons with Disabilities†, according to which the state guarantees the right of persons with disabilities to education and development of educational undertaking for persons with disabilities (Stewart 2003). However, it should be pointed out that, despite such a significant progress in legislation protecting disabled people and providing new opportunities for disabled in education, it still has some drawbacks, such as other rights, including the rights to health, access to information, participation protection, identification, etc., which are also very important for development of individuals, are not clearly spelled out in the existing legislation. Nonetheless, Chinese experience is noteworthy because it is really different from traditional approaches in developed countries, such as the UK, for instance. The main difference of Chinese policy and legislation is their focus on state support. In fact, the state plays the key role while private initiatives are practically deprived, if not forbidden, especially if compared to developed countries. At the same time, it raises the problem up to the national, state level and the solution is guided by the state mainly that helps to mobilize resources of the whole country that can be rarely observed in developed countries, where programs and non-profitable organizations play an important role in disabled education and integration of disabled people in a normal social life. B. Experience of the USATraditionally, the US is considered to be among the most democratic countries where the rights of all citizens are equal. However, it is not always true and such a judgment is often based on stereotypes and the situation with disabled in education reveals some problems that exist in this country. One of the main legislation acts that protected disabled people in education in the US was the Individuals with Disabilities Education Act but nowadays the American legislation concerning this problem is reviewed. The main aim of the changes of legislation is improvement and maintenance of quality of education of the disabled on both federal and local level. Since education in the US largely remains under local control, â€Å"many parents of the disabled find themselves acting as their own advocates to make sure the laws are upheld given the tendency of some locality to make decisions based on the idea that the expense of educating the disabled is more than they can handle† (Stewart 2003:365). As a result, the funding of programs aiming at the improvement of the position of disabled people in education often turns or seems to be insufficient. As for the recent trends in educating disabled people, the strategic goal for the past few decades has been to include them in classrooms of typical student. In all probability, this is a very perspective direction of integration of disabled people into conventional educational system and this would probably improve the situation in inclusive education but, at the same time, it is necessary to realize that it is quite a complicated process. On the one hand, it often needs some additional funding, on the other hand, it is a big problem for both disabled student and the rest of students because sometimes, for disabled students for instance, it is difficult be psychologically integrated in the class. Furthermore, another problem that may be perceived as a typical problem of the US is the inclusion of disabled children from different cultural communities. It is a well-known fact that often there exists a language barrier problem which makes the process of integration of a disabled child difficult to the extent that it is even possible to speak about language disability as another problem of a child’s inclusion in the classroom and school life. Nevertheless, the American legislation concerning the disabled in education may be considered to be quite progressive. For instance, its basic components include the following points (Stewart 2003): Children with disabilities have the right to enroll in any school at all levels; Schools have a mandate to provide education to all disabled children, otherwise they risk to lose government financial aid; Children with disabilities should be taught in the least restrictive environment and they should be ‘mainstreamed’ in regular classes so that they can develop appropriate peer models; Individualized education programs should be developed for children with disabilities, in order to ensure that each child gains the maximum benefit from special education. In such a way, formally disabled children have good perspectives for integration in regular education process. C. Experience of CanadaCanadian experience of the solution of the problem of disabled people in education is also noteworthy. It should be said that Canadian experience may be also treated as a relatively successful one like that of the US but, unlike in previous cases, it would be probably more interesting to dwell upon financial aspect of the problem, since, as the experience of the US shows, there may be problem with funding of programs contributing to better integration of disabled people into education. At this respect, it is possible to remind history. To put it more precisely, it is necessary to underline that the federal government never cost-shared over 50% of all provincial health care spending, and since 1977 has provided block-funding support to provincial health care and post-secondary education spending through a combination of cash and tax transfers (Prince and Frances 2000). Such a 50:50 cost-sharing regime covered a defined and restricted range of provincial spending on health care and education of disabled children. For instance, expenditures on mental and tuberculosis hospitals, home care, certain outpatient diagnostic services, administration costs, government financial aid to schools were not cost-shared. As a result, until 1977, the federal share of total provincial health care spending was never greater than 41% (Prince and Frances 2000). However, once the programs became established, all governments agreed to replace cost sharing of specific provincial expenditures on health and post-secondary education for disabled children with block funding, which â€Å"gives provinces much greater flexibility in how they allocate federal transfers, addressed provincial concerns that cost sharing distorted provincial spending decisions and favoured better-off provinces since they could afford to spend more and so attract more federal dollars than less well-off paying provinces† (Titchkosky 2003:418). In such a situation such an innovation contributed to better funding health care and education of disabled people that naturally helped to integrate them into normal social life as well as school life in particular. Obviously the increase of effectiveness of using the funds by local authorities contributed to the improvement of financial position of schools where disabled children studied and the position of children themselves. In fact, it is necessary to point out that proper funding is an essential condition of normal development of disabled children integration in education. Moreover, without good funding, it is impossible to speak about the realization of the goals of inclusive education for disabled children. This is why, the improved funding resulted in improved integration of disabled students.Also, it is very important to underline that in Canada, as well as in the US, non-profit organizations play a very important role in the solution of the problems disabled children face in their integration in a traditional school life. However, their activity is not sufficient and needs state support and the example above shows that the problems existing between federal and local authorities are quite typical for Canada and the non-profit organizations may actually face the same type of problems because of the lack of mutual understanding with the authorities. Recommendations as for improvement of disabled education in the UK Obviously, the current situation in the education system of the UK concerning disabled people is not perfect and needs to be improved. Taking into consideration the experience of other countries and new trends in this domain, it is possible to work out certain recommendations concerning improvement of disabled education in the UK. First of all, it should be said that it is necessary to integrate disabled students into traditional school system. It is not an easy task but it is quite realizable. To achieve positive results in this direction it is primarily necessary to make the conditions really equal for all students. It means that disabled student should have really equal rights and access to education and their disability should not be an obstacle isolating them from their peers and rest of society. Formally, the situation in the UK may seem not so bad because from legislative point of view disabled students in the UK have an opportunity to be really equal to other students, which do not have such problems. Reflection on Impact of Emerging Markets Essay The world of business has changed in recent years. Usually, the firms of developed countries dominated the globe and developed countries’ markets were the most attractive. However, new attractive markets and new players have emerged from areas outside the developed world. These new markets such as the BRICs and the MISTs have large populations, high economic growth and increasing demands for goods. Also, they are expected to surpass the developed economies by 2050 (Goldman Sachs, 2003). According to Jagdish N. Sheth, the emerging markets have impacted both the theory and the practice of marketing. The reason is very simple; marketing is a discipline that was developed in the concept of industrialized (developed) markets meaning that most of the marketing tools are designed to work specifically in industrialized markets (Sheth, 2011). Therefore, adapting most of what is known about marketing is necessary to succeed in new markets and new marketing research approaches need to be taken. The article Impact of Emerging Markets on Marketing: Rethinking Existing Perspectives and Practices covers some of the most important characteristics of these markets such as their growth, market heterogeneity, sociopolitical governance and comparative advantages. Also, the author suggests some changes that need to be made to the existing marketing theory, marketing strategy, marketing policy and marketing practice. Moreover, Sheth argues that companies (from developed countries as well as from the emerging countries) who succeed in the mentioned markets are becoming global competitors. The reason is that these firms have to innovate to overcome challenges such as shortages of resources, inadequate infrastructure and unbranded competition. As a result, innovation makes these firms more efficient as well as it creates a competitive advantage which allows them to compete globally. Having grown up in Mexico, one of the so called MISTs, I can relate many of Sheth’s marketing suggestions with some strategies used by Mexican companies. Some of these companies are already global players such as Grupo Bimbo, Cemex and America Movil (Inter-American Developing Bank, 2008). They are strong competitors in the bakery industry, building materials industry and telecom industry respectively. However, there is another rising player named Coppel S.A. de C.V. that already started to expand to other emerging markets outside Mexico, aiming to become a global competitor in the retail business. Coppel is family owned business with 1,000 stores and 80,000 employees in Mexico. Also, it has eight stores in Argentina and eight in Brazil. I will like to focus on Coppel, 2011’s biggest retailer in Mexico (El Economista, 2012), and how this company has already applied some of Sheth’s suggestions to marketing perspectives and practices. Even though the article mentioned many good points to succeed in emerging markets, the most important are purpose driven marketing, resource improvisation, and market development. Purpose driven marketing According to Sheth, purpose driven marketing is going beyond highlighting the benefits of a product or service, creating a lifetime value among the customers, employees and other stakeholders. Coppel wins its customers’ hearts with the slogan â€Å"Coppel Mejora tu vida† which translates to â€Å"Coppel improves your life†. Along with the slogan, Coppel offers a range of products such as clothes, furniture, electronic appliances and financial services to the 68 percent of the Mexican population whose monthly income is less than 2,743 pesos, close to 165 EUR (DigitalPersona, 2012). Most of the products sold by Coppel are products that fulfill the customers’ needs. At Coppel’s stores, it would be difficult to find expensive shoes or clothes. Also, Coppel guarantees all the furniture and any electronic product regardless of the brand sold at their stores up to 2 years; while most manufacturers only guarantee the first year. This warranty is very important to the customers since a washing machine or refrigerator can be equivalent to ten or eleven months of salary. In the financial services part, Coppel offers credit to buy goods in the store and cash loans up 1,000 EUR (loyal customers who have been Coppel’s clients for more than a year). Coppel is not as strict as many of the different financial institutions in Mexico which would never lend a single peso to any of Coppel’s customers. In other words, Coppel has a marketing policy of inclusive growth which means including in their policies those markets that marketers would have left out. In addition, Coppel extends its marketing to its stakeholders such as the community, employees, channel partners and suppliers. For the employees and their children, Coppel offers to pay half of their school tuition up to the master degree level as well as provide school supplies for them. Also, Coppel encourages its employees to get married by giving employees up to two months’ salary as a wedding present. Marriage is seen as a very important tradition in a conservative country such as Mexico. As a result, Coppel does improve the life of its customers as well as their stakeholders. It focuses on creating a lasting value to position itself as a company that offers more than just quality products and services. For this reason, Coppel has better financial performance than its competitors. Resource improvisation. â€Å"If necessity is the mother of invention, then resource shortage is the father of innovation† (Sheth 2011). For that reason, firms operating in emerging markets gain advantage by improvising with scarce resources, making them more innovative relative to their competitors. Coppel’s most innovative process is the use of a fingerprint biometrics in the point of sale (POS) and in all operating systems (DigitalPersona 2012). This system has helped to improve the verification process of purchases for 20.6 million customers since a customer can buy on credit (in the store) using just his or her fingerprint without using any type of identification. As mentioned, Coppel has close to 20 million registered customers’ fingerprints in their database. That represents almost 20 percent of the entire Mexican population, which allows Coppel to generate a reliable source of information about its customers. Reliable information about customers is not easy to have in emerging markets. For that reason, Coppel has an advantage over its competitors since it can use that information to create new marketing strategies to target a specific customer behavior. Also, the fingerprint system has reduced the possibility of fraud since every single customers information is linked to his or her fingerprint. This system has proved very useful in Argentina and Brazil where most customers (low income class) hardly carry an ID with them. Another innovating process is Coppel’s distribution system. The reason is that Coppel has 19 warehouses with 127 distribution centers to supply all its stores in 337 different cities in Mexico (DigitalPersona 2012). The distribution system is in-house designed which means that Coppel can modify it whenever is needed without having aid from an external provider. This decreases the response time when a challenge is raised. Also, Coppel’s system updates in real time. This means that the company knows exactly what products are being sold at any given time and what products are on the delivery trucks. In addition, Coppel daily supplies all the stores just with the right amount of goods that were sold the day before using small trucks with low gasoline consumption or pressured gas to keep down the cost. It also offers free delivery to its customers. This is a competitive advantage since other competitors do not offer it free of charge and almost half of the Mexican population does not have cars. Moreover, the distribution system is very efficient that some other retailers like Wal-Mart Mexico have tried to replicate it. In Mexico, Coppel is known as an innovative firm due to its distribution and fingerprint systems. Market development. While developed markets’ firms target customers’ needs using market intelligence, firms in emerging markets such as Coppel create customers’ needs by shaping customer expectations. In other words, create a â€Å"Field of Dreams† and customers will come. â€Å"Coppel mejora tu vida† is a statement that brings the customers to that â€Å"Field of Dreams†. Since customers in emerging markets are seeking to improve their life condition within their limited economic capacity, Coppel offers accessible and affordable products and services. Coppel has created and developed its own market over the last 70 years. The firm took care of the expectations of the poorest segment in Mexico and that segment has become Coppel’s most loyal customers. Therefore, developing a market brings more financial benefits than market orientation since the firm that develops a market gets the advantage and creates barriers for new entrants. Huawei in China and Avon in Brazil used marketing development to shape the customers’ expectations to positioning themselves in those markets. Nowadays, both of them are strong global competitors. Conclusion Coppel has the widest profit margin of any major Latin American retailer (Bloomberg 2012) because its strategies are based on purpose driven marketing, resource improvisation, and market development. Also, Coppel has developed a market as a result of a lifetime value that is attractive to all the stakeholders while innovating to overcome the challenges generated by the characteristics of operating in an emerging market. As mentioned by Sheth, new ideas from the emerging markets are impacting what we know about marketing. In the 1980s there was the belief that â€Å"The products and methods of the industrialized world play a single tune for all the world, and the world eagerly dances to it† which was written in the 1983’s article The Globalization of Markets by Theodore Levitt. This statement suggests that no adaptation was needed to Marketing practice and theory. On the other hand, Sheth says â€Å"the rise of emerging market is inevitable and it will have a disruptive impact on the marketing practice and theory† in 2011. Sheth’s article creates the bases of what is going to be new approaches for marketing research. The emerging markets will become the focus of the next generations of marketers and firms such as Coppel will be an example of how the emerging firms are shaped by their surroundings. To begin with, Smith makes roughly three claims about human nature. Primarily, Smith assumes that self-interest is inherent in all human beings. As opposed to animals which rely on benevolence, in opposition to natural pity (Rousseau p. 53), the human â€Å"will be more likely to prevail if he can interest [others’] self-love in his favour, and show them that it is for their own advantage to do for him what he requires of them† (Smith, p. 18). Smith later relies on this â€Å"self-love† to ground his arguments on the steady base of human nature. More subtly, the â€Å"faculties of reason and speech† play a crucial role in Smith’s treatment of human behavior. Although he never openly lists these â€Å"faculties† as essential to human nature, his argument relies on this assumption. The step from having some goods and needing others to trading with those who have the needed goods and want the overabundant ones cannot be warranted without a presumption of a rational actor. Similarly, every development towards improved efficiency, if these are anything more guided than random evolutionary steps, require such an actor to instigate it. In the case of the arrowmaker, Smith must assume some force driving the arrow maker to save time and maximize profits. Of course, the concepts of barter, trade, and the rest require speech, or some kind of communication. Finally, Smith instills â€Å"a certain propensity in human nature; the propensity to truck, barter, and exchange one thing for another.† (Smith p. 17). Nurses are not thought to be independent, making critical decisions for the patient. Instead, nurses are thought to only care for the patient while the doctor is gone. According to the American society of registered nurses, â€Å" The public perceive a nurse as just someone who assists the doctor during and after treatment of the illness assisting the patient in keeping up is personal hygiene, giving the medications as prescribed by the doctor, dressing the wounds when there is a need ensuring welfare of the patient† (American Society of Registered Nurses, 2007. para 1). This is a harmful image that creates a low expectation of what nurses are capable of. Therefore, nurses are endanger of not being taken seriously by patient families when their advise is given for a patient. People may want to speak to the doctor about patients health instead, even though the nurse is the one who sees the patient daily for long periods of time. The idea that a nurses role is easy, and simplistic is also shown in media as the nurses job is not well represented. The negative notions about nursing through television and other types of media need to be seriously exposed as they harm and form lies about nurses. Currently, â€Å"these images reinforce the farce that nurses are not critical thinkers and are dependent on physicians for every direction; that nursing is not a profession unto itself but that nurses are medical aids† (Ontario Nurses Association, 2008, p.1). Discussion The idea that nurses are not critical thinkers nor independent is damaging to the face of the nursing career. This train of thought causes people to underestimate the capabilities of nurses across Canada. The idea that we only follow doctors orders causes people to overlook what we do, labeling our work as unimportant. This attitude causes less funding into the nursing profession which leads to nursing shortages, creating over worked nurses and clinical error.As well as creating more part time jobs instead of full time, leaving many nurses no choice but to work more then one job. When a negative image is very dominant in Canadian culture, nurses in the working profession start to believe the lies about themselves, making nurses quiet and not speaking out against the image. The lack of credit nurses get for what they do can lead to them thinking their job is insignificant. Also, media is a main way that the younger canadian generations are being educated. By them learning wrong messages about nursing can create them to not wanting to pursue nursing as a career. This leads to less passionate nurses coming into the field who are unprepared for what they are signed up for. As a future nurse, the publics view of me is important. I want them to see me as a professional leader in the health care system. The idea that nurses are not critical thinkers and are depending on doctors for advise and orders counter acts the real job description is of me as a nurse. The negative assumptions about nursing can effect the way patients perceive me before having our first encounter. A patients doubts of my abilities a a nurse can make our interactions difficult at first if they look down on me. A patient support group is key to the patients recovery. Having family members doubting the capabilities of nurses can stop the patient and family from asking me questions regarding the overall health of the patient. When people expect me to just listen to the physician, not realizing that I make critical choices everyday, makes the patients take me for granted thinking that I am only a nurse. These thoughts will make my job more difficult as I will have to break through the wall of negative assumptions to allow patients , family and physicians see how independent, capable and professional I am as a nurse. To break down these negative images of nursing as a profession, nurses across Canada can use the media to their advantage by educating and showing people the full spectrum of nursing, allowing the public to understand that nurses make up a large portion of the health care system and are vital to each patients health and wellness. By educating the younger generations of Canada, nurses will be able to inspire and help people get passionate about nursing. This passion will bring more people into the workforce who are ready, excited and prepared for a rewarding career and will be able to shift the negative attitude towards the profession (Ontario Nurses Association, 2008). Each nurse in Canada should work hard and act professional to do their part in promoting a positive image that will reflect all canadian nurses as a whole. Having proactive nursing conferences across canada would help raise awareness of negative nursing images so that all nurses can be united and working towards the common goal of creating a more professional image of nursing in the eyes of the public. Currently, many nurses are being proactive by being integrated into the policy development on the healthcare and government level ( Ontario Nurses Association, 2008). The image of nursing must be changed, but all nurses need to come together as a team doing their part and taking pride in their identity as nurses. As a nurse, I will rise higher then the image of not being a critical thinker and only following doctors orders by always seeking more education so that I can be prepared for situations that I come across. I will stay current with health issues and events that occur around me both on a local and global level. I will always strive to be a leader in the health care system by taking pride when fulfilling my role as professional nurse. When patients or people in the community ask me about my career, I will make sure that I am always prepared by knowing in my heart the reason for my career choice, the importance of my profession and the impact it makes in the health care system, allowing the public to get the right perspective of me as a nurse. Also I will always think critically of any situation I am faced with, allowing the patient to receive the best and most professional care. Currently, I am going to do my part as a nursing student to strive for excellence while I have the opportunity of learning so much about my future career choice which will allow me to be confident in the skills I will acquire and have the joy in knowing that what I do will have an impact on many peoples lives.
